Abstract

Labor unions play a crucial role in protecting workers' rights, as regulated by Law No. 13/2003 on Manpower and Law No. 21/2000 on Trade Unions/Labor Unions. Article 25 of the Trade Union Law grants union officials the right to represent members, including in legal proceedings. This provision is reinforced by Article 87 of Law No. 2/2004 on Industrial Relations Dispute Settlement (PPHI), which permits union officials to act as legal representatives for members in the Industrial Relations Court (PHI).However, this authority creates a juridical problem as it potentially contradicts Law No. 18/2003 on Advocates, which stipulates that only sworn advocates are entitled to provide legal services in court. This research examines two main problems: the duties and functions of trade union officials towards their members, and the legality of non-advocate union representatives in receiving power of attorney to litigate in court on behalf of members. This discussion is vital to provide legal certainty for workers, ensure access to justice for economically disadvantaged groups, and prevent abuse of power. The research results indicate the need to align regulations among the Advocate Law, the Trade Union Law, and the PPHI Law to avoid legal norm overlap. Harmonization of regulations, competency certification, and a code of ethics for union officials performing legal representation functions are required. Special regulation is needed to balance the protection of workers' rights with legal professionalism. In conclusion, more definitive and harmonious regulations are needed regarding the authority of trade union officials to litigate in court to create legal certainty, rights protection, and justice for all parties in industrial relations.
