Abstract

Penelitian ini bertujuan untuk menganalisis praktik penahanan ijazah oleh pemberi kerja dalam perspektif kebebasan berkontrak dan perlindungan hukum bagi pekerja. Penahanan ijazah bertentangan dengan prinsip kebebasan berkontrak yang diatur dalam Pasal 1338 KUHPerdata, karena membatasi hak pekerja atas kepemilikan pribadi dan kebebasan untuk mencari pekerjaan. Perlindungan hukum terhadap pekerja dapat dilakukan melalui mekanisme pengawasan ketenagakerjaan, penyelesaian sengketa di Dinas Ketenagakerjaan, serta gugatan perdata untuk pemulihan ijazah dan ganti rugi. Meskipun tidak diatur tegas dalam perundang- undangan, prinsip perlindungan hak asasi manusia memberikan dasar hukum bagi pekerja untuk menuntut pengembalian ijazah yang ditahan. Dengan demikian, perlindungan hukum yang efektif harus melibatkan penguatan regulasi dan kesadaran hukum pekerja agar tindakan penahanan ijazah tidak terjadi secara sewenang-wenang oleh pemberi kerja.
