Abstract

Penggunaan ramuan herbal di Indonesia, sebagai bagian integral dari praktik kesehatan tradisional, semakin meningkat seiring dengan kesadaran masyarakat akan kesehatan. Namun, tantangan terkait keamanan, kualitas, dan efektivitas ramuan herbal juga muncul. Oleh karena itu, penelitian ini bertujuan untuk menganalisis perlindungan hukum bagi pasien dalam penggunaan ramuan herbal serta mekanisme pertanggungjawaban hukum tenaga kesehatan. Metode penelitian yang digunakan adalah penelitian hukum normatif, yang melibatkan analisis dokumen hukum dan regulasi terkait, termasuk Undang-Undang Nomor 17 Tahun 2023 tentang Kesehatan. Hasil penelitian menunjukkan bahwa meskipun kerangka hukum yang ada telah memberikan landasan yang kuat untuk pengaturan obat herbal, tantangan implementasi dan pemahaman oleh tenaga kesehatan masih perlu diatasi. Penelitian ini merekomendasikan peningkatan sosialisasi dan edukasi terkait peraturan kesehatan serta penguatan mekanisme pengawasan. Dengan demikian, diharapkan perlindungan hukum bagi pasien dalam penggunaan ramuan herbal dapat terwujud secara efektif dan berkelanjutan di Indonesia.
