Abstract

Tujuan Penulisan Skripsi ini untuk mengkaji dan mengetahui perlindungan hukum yang didapat oleh pihak ketiga sebagai pemilik sertifikat hak milik tanah sebagai jaminan pengganti oleh debitor di bank, dan pertanggungjawaban debitor terhadap sertifikat tanah milik pihak ketiga jika melakukan wanprestasi. Metode penelitian dalam skripsi ini menggunakan pendekatan yuridis normatif dengan aturan hukum yang berlaku di Indonesia, yang bersumber dari bahan hukum primer seperti Undang-Undang Dasar 1945, Kitab Undang-Undang Hukum Perdata, Kitab Undang-Undang Hukum Pidana, Peraturan Perundang-Undangan, serta pendapat para ahli hukum yang sesuai, dan bersumber dari bahan hukum sekunder. Hasil yang telah didapat bahwa perlindungan hukum bagi pihak ketiga secara perdata dan secara pidana. Pihak ketiga mendapatkan perlindungan secara perdata berupa ganti rugi dari debitor, sedangkan perlindungan secara pidana, pihak ketiga dapat melaporkan kreditur apabila melakukan penggelapan atas hasil lelang sertifikat tanah. Pertanggungjawaban dari debitor kepada kreditur yaitu berupa ganti rugi, namun jika debitor meninggal dunia maka pertanggungjawaban tersebut beralih kepada ahli waris dari debitor. Sehingga dapat disimpulkan bahwa tidak ada ketentuan yang melarang pihak ketiga untuk menjaminkan objeknya sebagai jaminan kredit, bentuk perlindungan hukum bagi pihak ketiga secara perdata berupa adanya ganti rugi dari debitor dan perlindungan secara pidana jika pihak kreditur melakukan penggelapan. Pihak ketiga dapat menuntut hak-haknya tersebut, melalui jalur litigasi ataupun non-litigasi.
