Abstract

This research examines legal protection for workers during the process of termination of employment, which often raises issues of uncertainty regarding workers' rights during this period. The primary focus of the study is to understand the types of sanctions that can be imposed on employers who neglect their obligations to workers during the termination process, as well as to analyze the legal measures workers can take to secure their rights. The approach used in this research is normative juridical, utilizing a legislative analysis approach in the field of labor law, specifically Law No. 13 of 2003 and Law No. 6 of 2023, which establishes Government Regulation in Lieu of Law No. 2 of 2022 on Job Creation as law. The findings of this study reveal that employers who fail to fulfill their obligations to workers during the termination process may face criminal or administrative sanctions. Workers can resolve disputes through litigation, namely in the Industrial Relations Court, or through non-litigation channels, such as bipartite, tripartite, conciliation, and arbitration processes. This research is expected to provide input for the government in establishing better regulations or policies to achieve justice for workers, especially during the termination process.
