Abstract

Skripsi ini berjudul Perlindungan Hukum Tehadap Buruh Dalam Kasus Kepailitan Studi Kasus Putusan Nomor 47/Pdt.Sus-PKPU/2022/PN Niaga Sby”. Penelitian ini memiliki tujuan untuk menganalisis perlindungan hukum yang diberikan kepada buruh pasca putusan tersebut serta Upaya hukum apa yang dapat dilakukan oleh buruh untuk mendapatkan hak upah dalam keadaan pailit tersebut. Metode penelitian yang digunakan adalah pendekatan yuridis normative, dengan mengkaji peraturan perundang-undangan terkait dengan dokumen putusan pengadilan, dan literatur hukum yang dianggap relevan. Hasil penelitian ialah, putusan Nomor 47/Pdt.SusPKPU/2022/PN Niaga Sby memberikan perlindungan hukum yang kuat bagi buruh dengan menegaskan hak-hak mereka sebagai kreditor Istimewa. Dalam konteks kepailitan, upah buruh diakui sebagai utang yang harus diprioritaskan dalam pembagian harta pailit, sesuai dengan ketentual Pasal 95 ayat (4) UU Ketenagakerjaan. Selain itu, buruh juga memiliki beberapa Upaya hukum yang dapat dilakukan untuk menuntut hak upah mereka, seperti mengajukan gugatan administrasi negara, atau mengajukan gugatan pidana, dan yang trakhir ialah mengajukan gugatan perdata. Dari ke tiga Upaya tersebut, tentunya memiliki kekurangan dan kelebihan masing-masing.oleh karena itu buruh/pekerja dalam kasus ini memilih mengajukan gugatan perdata. Dalam mengajukan gugatan perdatapun buruh/pekerjajuga harus memilih lagi gugatan mana yang lebih efektif dan efisien. Gugatan perdata kepailitan dipilih oleh buruh/pekerja karena memiliki jangka waktu yang tida terlalu lama untuk prosesnya, oleh karenanya muncullah putusan Nomor 47/Pdt.Sus-PKU/2022/PN Niaga Sby ini. Dengan demikian, penelitian inidiharapkan dapat memberikan kontribusi terhadap pemahaman mengenai perlindungan hukum bagi buruh dalam situasi kepailitan dan menjadi acuan bagi pengembang kebijaan serta praktik hukum yang lebh baik dimasa mendatang.
