Abstract

Dengan perkembangan pesat cryptocurrency sebagai instrument keuangan digital, isu manipulasi pasar seperti pump and dump, spoofing, dan wash trading menjadi tantangan besar bagi integritas pasar dan perlindungan investor. Praktik manipulasi dapat merusak kepercayaan masyarakat terhadap cryptocurrency serta menyebabkan kerugian finansial yang signifikan bagi investor. Rumusan Masalah dalam penelitian ini (1) bagaimana pengaturan terhadap larangan manipulasi pasar spot cryptocurrency dalam hukum positif di Indonesia; (2)bagaimana perlindungan hukum terhadap korban manipulasi pasar spot cryptocurrency di Indonesia. Tujuan dalam penelitian ini adalah untuk mengetahui pengaturan terhadap larangan manipulasi pasar spot cryptocurrency, serta untuk mengetahui Perlindungan hukum terhadap korban manipulasi pasar spot cryptocurrency di Indonesia. Manfaat dalam penelitian ini adalah untuk memberikan wawasan dan pengetahuan mengenai pengaturan larangan tindak pidana manipulasi pasar cryptocurrency dan diharapkan dapat memberikan masukan kepada pembetuk kebijakan mengenai pengawasan dan pengamanan cryptocurrency. Metode yang digunakan ialah penelitian yuridis normatif dengan menggunakan metode penelitian pendekatan perundang-undangan dan pendekatan konseptual. Menggunakan bahan hukum primer, bahan hukum sekunder, dan bahan hukum tersier, dengan teknik pengumpulan bahan hukum studi kepustakaan dan menggunakan teknik analisis normatif yang bersifat preskriptif. Adapun Kesimpulan dalam penelitian ini, regulasi di Indonesia terkait larangan manipulasi pasar spot cryptocurrency masih lemah dan belum mencakup tindak pidana spesifik seperti pump and dump, spoofing, dan wash trading. Kekosongan hukum ini memberikan peluang bagi pelaku untuk memanipulasi pasar, yang berdampak pada kerugian investor dan menurunnya kepercayaan terhadap pasar cryptocurrency. Dibandingkan dengan regulasi di negara maju seperti Amerika Serikat dan Uni Eropa, Indonesia memerlukan kerangka hukum yang lebih komprehensif. Peraturan tersebut harus mencakup pengawasan ketat, sanksi yang jelas, serta kolaborasi antara lembaga nasional dan internasional untuk menciptakan ekosistem yang aman, transparan, dan kompetitif. Dengan revisi Peraturan dan implementasi teknologi berbasis blockchain, diharapkan pasar cryptocurrency di Indonesia dapat berkembang secara sehat dan melindungi investor secara optimal.
