Abstract

The concern over the security of consumers' personal data, which is susceptible to hacking and misuse by irresponsible parties, must be the government's primary focus through the establishment of Law Number 27 of 2022 on Personal Data Protection. This writing primarily addresses the case involving Tokopedia e-commerce. Issues surrounding the security and privacy of personal data arose from a data breach in May 2020, where the information of 91 million Tokopedia users was hacked and sold on the dark web. This research examines the legal protection arrangements and measures that can be taken for users who experience personal data leaks from Tokopedia, using a normative research approach. Normative juridical research, or normative methods, involve referencing secondary legal materials or library resources. The findings from this research indicate that Tokopedia is responsible for informing users within 14 days and taking steps to secure its system. Tokopedia is also enhancing password encryption and appointing independent institutions for investigations. Criminal sanctions under Articles 67 and 68 of Law Number 27 of 2022 on Personal Data Protection can be imposed on corporations, including their management, control holders, order givers, beneficial owners, or the corporation itself. The only penalties that can be imposed on a corporation are fines, confiscation and freezing of assets, and the revocation of Tokopedia's license.
