Abstract

There is a problem regarding the use of the Enhanced Smart Architecture Frame (eSAF) on Honda brand motorcyclesthat have production defects. The eSAF frame has been introduced as a design innovation in the motorcycle industry. However, there are some cases of damage to the frame, which can cause accidents and lossesto consumers. Thisresearch method uses juridical-normative, namely by using literature studies from data, positive law, and other legal materials. The purpose of this study is to analyze the aspects of consumer legal protection and the responsibility of manufacturers related to the use of defective eSAF frames with a case study on damage to Honda automatic motorcycle frames. The results of the study show that consumers who have an accident due to the use of eSAF frames have not received legal protection because Article 4 of the UUPK has not been fulfilled, namely consumers are entitled to receive compensation for losses caused by the use of products and Criminal Code Articles 1504 - 1512 related to defective products. In addition, PT. AHM has also not carried out its responsibilities properly, because it has rejected claims for losses experienced by consumers and withdrawn its products so that it is contrary to Article 7 of the UUPK jo. Article 8. Regarding the use of eSAF frames on motorbikes that have production defects, the government should conduct an investigation into this case as a step to prevent public accidents and provide strict sanctions for business actors who are proven to be detrimental to consumers. PT. AHM as a business actor must immediately recall all its products that use the eSAF framework as a form of responsibility and compensate consumers for losses experienced when accidents occur during the use of their products.
