Abstract

This research aims to clarify the concept of victims and perpetrators of multiple traffic accidents based on the Traffic Law and the Road Transport Law. Provisions regarding the position of victims are specifically regulated in Law no. 22 of 2009 concerning Road Traffic and Transportation which regulates the concept of victims where a victim is anyone who experiences loss in the form of serious injury or death as a result of a traffic accident. If the concept of victim is related to a traffic accident, it will give rise to the perception that anyone who is seriously injured or dies will be seen as a true victim, even though in a traffic accident, it could happen that the victim is also the perpetrator who was negligent in driving. Apart from that, the concept of victims contained in Law no. 22 of 2009 concerning Road Traffic and Transportation is in conflict with the concept of victims as regulated in the applicable laws and regulations in Indonesia, so that a comprehensive interpretation of the concept of victims is needed in the context of fair law enforcement. This research method uses normative juridical legal research. Meanwhile, the approach used in this research is a statutory approach, a conceptual approach and the legal materials used are primary legal materials and secondary legal materials. The results of this research determine the concept victims and perpetrators in traffic and road transport laws as well as efforts to resolve disputes along with the rights of victims who died in multiple traffic accidents based on traffic and road transport laws.
