Abstract

The purpose of this study is to find out and explain how the elements of the criminal aspect that can be provided by criminals who are usually often carried out by merchants in cash swipe transactions and also the legality aspect regarding Cash Swipe Transactions the imposition of criminals who harm victims so that it has a purpose for everyone to anticipate or provide information about the dangers of using cash swipe transactions. Emphasizing efforts to circulate cash swipe transactions to merchants that are educational and informative. The type used in this study is normative legal research and this study uses several approaches, namely the conceptual approach (Conceptual Approach) and this study uses several legislative approaches (Statue Aproach), and case approach (Case Approach) quoting from Peter Mahmud Marzuki. The result of this study is that the regulation regarding sanctions that can be imposed on cash swipe merchants apparently does not exist but only administrative sanctions. So it is necessary to be given criminal sanctions in order to provide the perpetrator with accountability for his actions, then the imposition of a criminal element of crime from the perpetrator can be given Article 28 paragraph 1 of the Information and Transaction Law and also Article 372 which regulates embezzlement as a relevant legal basis in handling this case of cash swipe transaction crime. Which refers to manipulating other people's personal data is then intended to gain profits so as to result in losses by the victim. The criminal liability of the perpetrators of embezzlement and theft of personal data should be seen from two legal perspectives, namely based on the Criminal Code and the Information and Electronic Transactions Law, thus that the imposition of criminal sanctions should also be given in order to provide responsibility for their actions and also the suffering that should be given to violators of criminal rules. emphasizing the dangers of Cash Swipe Transaction Crime.
