Abstract

An heir must seek approval from other heirs when transferring their inheritance rights because the other heirs also have rights to the inheritance. If someone entitled to inherited land claims to be the sole owner of the land, such a transfer should not be considered valid based on implicit conditions. To transfer land rights, the party wishing to do so must have the approval of the other heirs. Without this approval, the transfer of land rights is not allowed. The transfer of land rights without the approval of other heirs is not permitted in Indonesia. This research aims to understand the legal protection available to heirs who do not give consent to the transfer of land rights and the legal consequences if the transfer of land rights proceeds without the consent of the other heirs. The method used in this research is normative juridical with an approach based on legislation and conceptual regulations. The results of this research indicate that the legal consequence of transferring land rights without the consent of the heirs is an unlawful act in accordance with Article 1365 of the Indonesian Civil Code (KUHPerdata), whereby heirs who feel their rights are violated can file a civil lawsuit based on unlawful acts. Article 834 of the Indonesian Civil Code also grants heirs the right to file a lawsuit to claim their inheritance rights against individuals who possess all or part of the inheritance, whether those individuals possess it based on the same right (as heirs) or without any legitimate right to the inheritance.
