Abstract

The Indonesian state has a legal basis regarding online gambling as regulated in Article 27 paragraph 2 and Article 45 Paragraph 3 of Law Number 1 of 2024 concerning Information and Electronic Transactions that "every person intentionally and without right distributes and/or transmits and/or make accessible Electronic Information and/or Electronic Documents containing Gambling content. However, the fact is that there are still online gambling sites in Indonesia, one example is the Sbobet site. Based on this, the author formulates the problem of how to enforce the law in eradicating online gambling sites in Indonesia as well as forms of accountability for perpetrators of online gambling crimes based on the Indonesian criminal law system. With this aim, it is hoped that this author can provide benefits to the development of legal science, especially in criminal law. To answer the various problems researched by the author, the author uses a research approach based on journals and applicable laws as well as a normative approach. The results of this research confirm that the practice of online gambling site service providers in the Indonesian criminal system is regulated in Article 27 paragraph 2 of Law Number 1 of 2024 concerning ITE and Law No. 1 of 2023 in Chapter VIII concerning Online Gambling. However, in the law enforcement process itself there are several internal and external inhibiting factors. Jurisdictionally in Law Number 1 of 2024 concerning ITE and Law No.1 of 2023 in Chapter VIII concerning Online Gambling has jurisdiction not only for legal acts that apply in Indonesia, but also applies to legal acts carried out outside the jurisdiction of Indonesia either by Indonesian citizens or foreign citizens or Indonesian legal entities or foreign legal entities which have legal consequences in Indonesia.
