Abstract

Health is a very important thing in everyday life, so the government is obliged to guarantee health for the entire community, so as to guarantee the health of every community, the government creates national health insurance, namely in the form of BPJS Health. Hospitals that collaborate with BPJS Health sometimes commit fraud, giving rise to discrimination, for BPJS Health participants, one of which is on the grounds that the quota for BPJS Health participants is full so they need to be upgraded. There is a formulation of the problem, What are the laws and regulations for treating BPJS patients? And also what are the legal remedies for BPJS Health users if there is an act of discrimination?. The type of research method used in this research is the normative legal research method. Using a Legislative Approach and a Conceptual Approach. Using primary legal material sources in the form of statutory regulations, and secondary legal sources in the form of scientific journals and books in the legal field. The results of this research are hospitals that commit fraud or deception in serving patients on the grounds that the quota for BPJS is full and a class upgrade is required, but in reality it is not full so that BPJS participants feel disadvantaged, which can be said to be discrimination. Participants who experience fraud resulting in discriminatory behavior in hospital services can request compensation based on the legal basis, namely Article 32 Letter C of the Hospital Law which states that patients have the right to receive services that are humane, fair, honest and without discrimination.
