Abstract

Negara Indonesia telah memiliki landasan hukum terkait perjudian online sebagaimana diatur dalam Pasal 27 ayat 2 Undang-Undang Nomor 19 Tahun 2016 Tentang Informasi dan Transaksi Elektronik bahwa “setiap orang dengan sengaja dan tanpa hak mendistribusikan dan/atau mentransmisikan dan/atau membuat dapat diaksesnya Informasi Elektronik dan/atau Dokumen Elektronik yang memiliki muatan Perjudian”. Namun faktanya masih ada situs-situs judi online di Indonesia, salah satu contohnya adalah situs sbobet. Berdasarkan hal tersebut, maka penulis merumuskan permasalahan bagaimanakah penegakan hukum dalam pemberantasan situs judi online di Indonesia serta bagaimanakah pemidanaan terhadap bandar situs judi online Internasional berdasarkan sistem hukum pidana Indonesia. Dengan tujuan, penulis ini diharapkan dapat memberikan kegunaan terhadap perkembangan ilmu hukum khususnya dalam hukum pidana. Untuk menjawab berbagai permasalahan yang diteliti oleh penulis, maka penulis menggunakan pendekatan penelitian doctrinal dan pendekatan secara normatif. Dalam penulisan ini penulis mengambil data yang bersumber dari ketentuan perundang- undangan, teori terkait corporate crime, dan perjanjian internasional (black letter law). Hasil penelitian ini menegaskan bahwa praktek penyedia layanan situs perjudian secara online dalam hukum sistem pidana Indonesia telah diatur dalam Pasal 27 ayat 2 Undang-Undang Nomor 19 Tahun 2016 Tentang ITE. Namun dalam proses penegakan hukum itu sendiri ada beberapa faktor penghambat dari internal maupun eksternal. Secara yurisdiksi dalam Undang-Undang Nomor 19 Tahun 2016 Tentang ITE memiliki jangkauan yurisdiksi tidak semata-mata untuk perbuatan hukum yang berlaku di Indonesia, tetapi juga berlaku untuk perbuatan hukum yang dilakukan di luar wilayah hukum Indonesia baik oleh warga negara Indonesia atau warga negara asing atau badan hukum Indonesia atau badan hukum asing yang memiliki akibat hukum di Indonesia.
