Abstract

Along with the rapid development of the times and technology, which also requires special adjustments in the field of law, including updates in the field of corruption law, which in NRI Law Number 20 of 2001 concerning Amendments to the Law of the Republic of Indonesia Number 31 of 1999 concerning the eradication of Corruption Criminal Acts is made separate from the Criminal Code (Weetboek van Straftrecht) and is currently made one with the New Criminal Code, Although there are still rudimentary ones, they can be used as a legal basis in the future. The writing of this thesis aims to analyze the criminal sanctions of social work against perpetrators of corruption crimes sentenced to minimum criminal sentences, so that the state can utilize the expertise of the convicted if the convict works as a health worker, then the state can provide space for a social activity, so that his expertise can benefit people in need. The research method used is normative research. The results of this study show that the application of the theory of relative purpose through social work criminal sancsionis a form of justice, and is expected to reduce the crime rate of corruption, especially in the health sector. In Indonesia, the crime of social work sanctions has only been included in the New Criminal Code (Law No. 1 of 2023).
