Abstract
This research was conducted to analyze Article 7 of the Presidential Regulation of the Republic of Indonesia Number 88 of 2017 concerning ownership of certified land that is included in forest areas which often occurs in Indonesian territory. and forms of conflict resolution of the problems faced. The method of this research is normative legal research, using statutory and conceptual approaches. Based on the analysis, the authors conclude that certificates have a legal position as a strong means of proof, as the nature of proof of certificates as proof of property rights has been explained in Article 19 paragraph (2) letter c of the BAL, namely "certificates as strong evidence, namely physical data and juridical data what is contained in the certificate is considered correct as long as it is not proven otherwise by other evidence. Based on the provisions of Article 32 paragraph (1) PP No. 24 of 1997 the publication system for land registration that he adheres to is a negative publication system, namely a certificate is a proof of absolute rights. This means that the physical data and juridical data contained in the certificate have legal force and must be accepted as true information as long as there is no other evidence. From this explanation, referring to article 7 of Presidential Regulation No. 88 of 2017, the national land agency is obliged to issue land parcels that are included in forest areas through changes to forest area boundaries, with that legal certainty regarding certificates of ownership of these lands to become official and legally valid certificates.
