Abstract
ABSTRACT BANK RESPONSIBILITY FOR CUSTOMERS LOST OF FUNDS THROUGH CREDIT CARD SKIMMING Credit card skimming is a condition where the bank's security system related to data confidentiality is carried out by a number of perpetrators and results in losses to consumers, as a new crime, the urgency of this research is to examine in depth skimming credit card actions, especially for victims as the injured party. The type of legal research used in this study is normative juridical research. In this study the authors used a statutory approach (The Statue Approach). This study uses primary legal materials namely legislation, secondary legal materials and tertiary legal materials. The technique of collecting legal material is done by studying literature. Analysis of the legal materials used in this study is the technique of description, interpretation, systematization, argumentation, and evaluation. The results of this study are the case of credit card skimming the burden of proof of the presence or absence of an element of error in the claim for compensation as referred to in article 28 of Law Number 8 of 1999 is the burden and responsibility of the business actor. Regarding the form of legal protection given to customers, article 19 paragraph (1) and (3) of the Consumer Protection Act states that consumers who feel disadvantaged can directly demand compensation from producers.
