Abstract

The Fixed-Term Employment Agreement (PKWT) is a form of employment relationship designed to provide flexibility within the labor system. However, the regulations governing PKWT specifically under Law Number 6 of 2023 concerning Job Creation and Government Regulation Number 35 of 2021 continue to raise issues regarding legal certainty concerning worker status and the fulfillment of workers' rights. This study aims to analyze the alignment of the employment system for PKWT workers with the principle of legal certainty and to examine the legal implications of PKWT status regulations on the fulfillment of workers' rights. This is a normative legal study employing both statutory and conceptual approaches. The legal materials utilized—comprising primary, secondary, and tertiary sources—were analyzed normatively using a deductive method. The findings indicate that PKWT regulations do not yet fully provide legal certainty, as there are no provisions explicitly governing the conversion of a PKWT worker's status to that of an indefinite-term worker (PKWTT) following a continuous employment relationship. This situation potentially creates uncertainty regarding the status of the employment relationship and diminishes the protection of workers' rights. Therefore, it is necessary to refine PKWT regulations by formulating clearer norms regarding worker status to ensure legal certainty, legal protection, and a balance of rights and obligations between workers and employers, in accordance with the principles of a state based on the rule of law.
