Abstract

This study examines the legitimacy of the involvement of the Indonesian National Armed Forces (TNI) in the protection of prosecutors under Presidential Regulation No. 66 of 2025, placing it within the framework of Military Operations Other Than War (OMSP) under Law No. 3 of 2025. This analysis departs from the post-reform constitutional design that explicitly separates the functions of national defense and domestic security. This research uses normative legal methods with a statutory and conceptual approach to assess whether the protection of prosecutors meets the parameters of OMSP, particularly regarding the character of the threat, the basis of legal authority, civilian control mechanisms, and the principle of temporality. The results of the study indicate that threats against prosecutors are generally criminal and individual in nature, falling within the realm of law enforcement, and therefore do not reach the threshold of extraordinary threats that could justify military involvement. Furthermore, this article asserts that Presidential Regulation No. 66 of 2025 has the potential to exceed the limits of delegative authority because it substantively expands the role of the TNI beyond the corridors established by law. This expansion blurs the constitutional boundaries between defense and domestic security functions and risks weakening the principle of civilian supremacy in a democratic state governed by law. Thus, the involvement of the TNI in protecting prosecutors is not supported by an adequate normative basis and has the potential to give rise to deviations in the governance of civil-military relations in Indonesia.
