Abstract

The development of the digital economy has given rise to new forms of work known as gig work, in which work relationships no longer fully fall within the framework of formal employment as regulated under Indonesian labor law. This condition raises legal issues, particularly concerning the legal recognition of gig workers and its implications for occupational safety and health protection. The absence of clear legal status places gig workers in a vulnerable position, despite the work-related risks they face being comparable to those of formal workers. This study aims to analyze the legal recognition of gig workers within the Indonesian labor law system and to examine the adequacy of occupational safety and health protection provided to them. The research employs a normative legal research method using statutory and conceptual approaches. Legal materials consist of primary, secondary, and tertiary sources, which are analyzed qualitatively through legal reasoning. The findings indicate that the lack of explicit legal recognition of gig workers has resulted in insufficient occupational safety and health protection. Therefore, legal reform is necessary to formally recognize gig workers as subjects of legal protection, particularly in the context of occupational safety and health, in order to ensure fair and sustainable legal protection.
