Abstract

The increasing use of scientific evidence in corruption cases reflects the complexity of modern crime as well as advancements in science and technology. However, Indonesian criminal procedure law has not yet recognized scientific evidence as an independent means of proof, leading to legal uncertainty and inconsistency in judicial practice. This research aims to analyze the urgency of regulating scientific evidence in proving corruption offenses and to formulate its regulatory construction to ensure legal certainty. The research method used is normative legal research with a legislative, conceptual, and comparative legal approach. Legal materials were analyzed thru a study of legislation, doctrine, and evidentiary practices in several jurisdictions. The research findings indicate that the absence of a clear normative framework often leads to scientific evidence being subordinated to expert testimony or documentary evidence, thereby weakening the consistency of decisions, procedural fairness, and the protection of the defendant's rights. This research found that scientific evidence needs to be constructed as an independent tool of proof subject to measurable admissibility standards, including tests of methodological reliability, chain of custody, accreditation of experts and forensic laboratories, and the active role of judges as gatekeepers. This construction is expected to enhance the objectivity and accountability of proving corruption cases, while also aligning Indonesian criminal procedure law with the principles of legal certainty, due process of law and international best practices.
