Abstract

In practice, surrogacy has become an issue that raises complex debates between legal, ethical, and human rights aspects. This study raises two problem formulations, namely: 1) Surrogacy from the perspective of Reproductive Health Rights, and 2) Formulation of Rules on Surrogacy based on Reproductive Health Rights. This type of research is a normative legal research using a legislative approach, a conceptual approach, and a comparative approach, as well as using secondary legal materials obtained from literature studies. The results of the study indicate that normatively, the practice of surrogacy is not recognized and is contrary to positive Indonesian law because it does not comply with the provisions of Article 58 of Law Number 17 of 2023 concerning Health, which states that assisted reproduction can only be carried out by legally married couples by implanting the results of fertilization in the wife's own uterus. The prohibition on surrogacy is also reinforced by Government Regulation Number 28 of 2024 and moral principles that reject the involvement of third parties in the reproductive process. Based on the results of comparisons with India, Italy, and France, it was found that India applies a limited regulatory approach, while Italy and France are prohibitive on moral and ethical grounds. This study concludes that the practice of surrogacy in Indonesia is contrary to the principles of protecting reproductive health rights, women's dignity, and legal certainty for children, so it is necessary to formulate regulations on surrogacy based on Reproductive Health Rights, namely by adding articles in the Health Law that explicitly state the prohibition of Surrogacy and formulating sanctions for surrogacy practitioners (for those who offer, surrogate mothers, and Human Resources (HR) in the Health sector who assist with surrogacy.
