Abstract

Land is a valuable asset with both economic and social functions and can be inherited across generations. In practice, however, inherited land often becomes abandoned due to unclear ownership status, absence of occupation, or lack of utilization. This situation creates legal consequences, as the government through Government Regulation No. 20 of 2021 as the authority to classify such land as abandoned and reassign its use for public purposes. This policy raises issues regarding legal protection for heirs, particularly in relation to certainty of rights and the availability of objection mechanisms when land is designated as abandoned. This research aims to analyze the regulatory framework and mechanisms governing the determination of abandoned inherited land, as well as to assess the forms of legal protection afforded to rights holders. The study employs a normative juridical method with statutory and conceptual approaches, supported by literature review on agrarian regulations, legal doctrine, and academic sources. The findings indicate that although procedures for identifying abandoned land are regulated, there is no clear mechanism enabling heirs to defend their rights when such designation occurs. Existing legal protection is predominantly repressive, relying on administrative objections and judicial remedies, which do not fully guarantee legal certainty for heirs. Therefore, strengthening the regulatory framework is required to provide preventive legal protection and a more transparent objection mechanism, ensuring justice and recognition of land ownership rights.
