Abstract

This study aims to determine the form of criminal sanctions against children as perpetrators of narcotics abuse and to determine the form of legal protection against children as perpetrators of narcotics abuse. The type of research in writing this thesis is carried out with a type of normatice legal research in the form of library research that uses 3 (three) legal materials. This legal research focuses on literature studies which means that it will examine and study more existing legal rules. The results showed that criminal sanctions against children as perpetrators of narcotics abuse, namely in the form of punishment and rehabilitation. However, the punishment for children can only be imposed ½ (one-half) of the maximum adult sentence. Reharding rehabilitation, it is known that there are 2 (two) types of rehabilitation, namely medical rehabilitation and social rehabilitation. The rehabilitation aims at recovery normatively it seem that its implementation is carried out in an integrated manner both physically, mentally, and socially. Therefore, children who commit criminal acts as perpetrators of narcotics abuse can carry out social activities in social life. Based on Law Number 35 of 2014 concerning amendments to Law Number 23 of 2002 concerning Child Protection in Article 1 number (2) states that “child protection is all activities to ensure and protect children and their rights so that they can live, grow, develop, and participate optimally in accordance with the dignity of humanity, and receive protection from violence and discrimination”. Based on Article 67 of Law Number 35 of 2014 concerning Child Protection explains that special protection for children who are victims of perpetrators of abuse of narcotics, alcohol, phsycotropic substances, and other addictive substances as referred to in Article 59 paragraph (2) letter e and children involved in abuse is carried out through supervision, prevention, care and rehabilitation efforts.
