Abstract

The dispute in the North Natuna Sea has emerged as a critical issue in the context of international maritime law, particularly regarding overlapping claims between Indonesia and the People’s Republic of China (PRC). China has unilaterally claimed the area as part of its traditional fishing grounds based on the historical Nine-Dash Line concept. In contrast, Indonesia asserts its sovereign rights over the Exclusive Economic Zone (EEZ) in the North Natuna Sea under the provisions of the United Nations Convention on the Law of the Sea (UNCLOS) 1982. This legal conflict has resulted in a status quo that creates uncertainty regarding the management of natural marine resources, especially in terms of Indonesia’s ability to fully exercise its rights to explore and exploit resources in the area. This study aims to analyze: the legal status of Indonesia’s EEZ management in the North Natuna Sea under UNCLOS 1982; and the legal consequences arising from the current status quo regarding Indonesia’s sovereign rights. This research applies a normative legal method using both a statute approach and a conceptual approach. Findings show that Indonesia has a legitimate and well-established legal foundation under international law to manage the EEZ in the North Natuna Sea, as stipulated in Articles 55 to 58 of UNCLOS 1982. However, China’s unilateral claim has caused a de facto dispute that undermines Indonesia’s effective control over the area. The frequent presence of foreign vessels conducting fishing and patrol activities without Indonesia’s consent constitutes a violation of its jurisdiction. To safeguard its sovereign rights, Indonesia must adopt strategic measures including strengthened maritime surveillance, international diplomatic engagement, and enhanced regional cooperation to ensure that the management of its EEZ is protected in accordance with international law.
