Abstract
Penelitian ini membahas konsep pemeliharaan anak terlantar berdasarkan peraturan perundang- undangan di Indonesia yang tidak memiliki status kewarganegaraan yang jelas. Anak terlantar merupakan kelompok yang sangat rentan terhadap pelanggaran hak, baik secara fisik, mental, spiritual maupun sosial. Permasalahan utama yang diangkat adalah bagaimana konsep pemeliharaan anak terlantar menurut ketentuan hukum positif di Indonesia, serta bagaimana perlakuan terhadap anak-anak tanpa kewarganegaraan. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan pendekatan perundang-undangan dan konseptual. Hasil dari penelitian ini menunjukkan bahwa meskipun regulasi telah mengatur secara eksplisit tentang perlindungan dan pemeliharaan anak terlantar, namun dalam praktiknya masih terdapat kekosongan hukum dalam mekanisme identifikasi dan pemeliharaan anak tanpa kewarganegaraan. Penelitian ini merekomendasikan adanya pembaruan kebijakan dan mekanisme implementasi yang lebih efektif, kolaborasi antarinstansi, serta peran aktif masyarakat dalam mendukung pemeliharaan dan perlindungan anak terlantar. Kata kunci: anak terlantar, pemeliharaan anak, perlindungan anak, kewarganegaraan, hak anak.
