Abstract

This research examines Decision Number 15-K/PM.III�14/AD/VI/2023, Decision Number 868/Pid.B/2021/PN JKT SEL, Decision Number 3305/Pid.B/2020/PN Mdn and Decision No. 13/Pid.B/2023/PN Sby by analyzing the acquittal decision handed down to the defendant in a murder case focusing on the perspective of substantive justice. This case has valid evidence in the trial of alleged criminal acts committed by the defendant, thus reflecting the various challenges that exist in the criminal justice system in Indonesia. The public considered the judge's decision to be unfair, causing dissatisfaction, even though there were several cases where forensic evidence showed that the defendant was involved in the victim's death. This research uses normative legal methods with a conceptual approach and case studies to see how far substantive justice is applied in the court decisions. Substantive justice explains the importance of a fair final result and is not just a legal procedure. The findings in this research indicate that judges' decisions should take into account human values and social justice in order to fulfill society's expectations for justice. Therefore, it is necessary to improve the criminal justice system for law enforcement agencies to create a more transparent and accountable justice system, so that justice can be felt by all parties involved.
