Abstract

The phenomenon of parallel import is one of the activities resulting from trade liberalization in the global market. Parallel import literally refers to the activity of importing goods with legitimate brands, but not through authorized distribution channels. This certainly causes losses for licensors and licensees, as these losses are included in the lucrum cessans losses. Parallel import activities in Indonesia certainly do not have a clear legal umbrella. When referring to the Law of the Republic of Indonesia Number 20 Year 2016 on Trademarks and Geographical Indications (MIG Law), it has a less broad scope of protection of trademarks. This has resulted in the court often being less consistent and making substantial interpretation errors in deciding a case related to parallel import. Therefore, the legal issues in this study are divided into 2 (two), namely: first, legal regulation of parallel import activities for trademark holders in Indonesia and second, legal protection for trademark holders against parallel import activities in Indonesia. This research is a normative legal research, as it uses 3 (three) approaches, namely the statutory approach (statue approach), conceptual approach (conceptual approach), and comparative approach (comparative approach). The results of this study show that although the MIG Law provides a legal basis to protect trademark holders, there is no clarity regarding the regulation of parallel import activities that often cause harm to licensors and licensee. In addition, the MIG Law lacks clarity regarding the use of the exhaustion right principle in the distribution of a commodity. Often, trademark holders have to resort to repressive measures to restore their rights. Therefore, in order to restore the rights, the trademark holders can file a lawsuit through the doctrine of unjust enrichment.
