Abstract
Sebagai lembaga yang dengan fungsi quasi-yudisial, Bawaslu memiliki kewenangan untuk memberikan putusan atas serta penyelesaian sengketa proses pemilu. Putusan tersebut, berdasarkan ketentuan hukum yang berlaku, bersifat final dan mengikat. Bawaslu memiliki kekuatan yang final dan mengikat di setiap keputusan yang dikeluarkan. Namun, implementasi atau bentuk tindak lanjut dari putusan tersebut sering kali menghadapi tantangan, terutama dalam bentuk pembangkangan berupa penundaan dan/atau tidak ditindaklanjuti oleh KPU sebagai penyelenggara pemilu yang semestinya menjalankan putusan tersebut. Kewajiban pelaksanaan paling lama 3 (tiga) hari kerja untuk putusan Bawaslu dapat diketahui belum dilakukan secara maksimal oleh KPU mempertanyakan sifat final dan mengikat putusan Bawaslu. Hasil penelitian adalah perlu adanya pembaruan terkait kewenangan Bawaslu untuk menegakkan kepatuhan terhadap putusannya. Undang- Undang No. 7 Tahun 2017 maupun Perbawaslu belum mengatur secara tegas tentang daya paksa maupun bentuk pengawasan Bawaslu atas tindak lanjut putusan yang telah dikeluarkannya. Hal tersebut mengakibatkan ketidakpastian hukum bagi putusan Bawaslu yang mengikat, terutama apabila putusan tersebut ditunda dan/atau tidak ditindaklanjuti. Oleh karena itu, penelitian ini memberikan rekomendasi model pengaturan untuk memperkuat daya paksa putusan Bawaslu termasuk mekanisme sanksi terhadap pihak penyelenggara pemilu yang tidak menindaklanjuti putusan Bawaslu
