Abstract

Pasal 70 Undang-Undang Nomor 11 Tahun 2012 mengatur mengenai pemaafan hakim, namun dalam bagian Penjelasan, belum ada ketentuan lebih rinci mengenai penjelasan pasal tersebut terutama pada makna “ringannya perbuatan” sehingga menimbulkan ketidakpastian hukum. Metode dalam penulisan ini ialah penelitian hukum normatif dengan pendekatan perundang-undangan (Statue Approach) dan Konseptual (Conceptual Approach). Tujuan penelitian ialah untuk memahami dan menganalisis apa yang dimaksud dengan ringannya perbuatan sebagai dasar pertimbangan hakim dalam memberikan putusan pemaaf. Hasil penelitian menunjukkan bahwa dengan mempertimbangkan ancaman pidana terhadap pelaku anak, maka Pasal 70 UU SPPA, khususnya frasa “ringannya perbuatan”, dapat dimaknai sebagai tindak pidana ringan. Kata Kunci : Anak; Ringannya Perbuatan; Tindak Pidana.
