Abstract

A crime is a violation of norms regarding the disruption of legal order intentionally (dolus) or unintentionally/negligence (culpa) committed by the perpetrator of the crime. According to Simons, a crime is a behavior (handeling) that is threatened with criminal penalties, which is unlawful, related to errors and committed by a person who is capable of being responsible. The crime of murder is an attempt by the perpetrator to intentionally take someone's life. The murderer (doodslag) is threatened with a maximum imprisonment of 15 (fifteen) years (Article 338 of the Criminal Code). Cases of criminal acts, especially murder, occur very often, and victims often do not get justice because it is difficult to find evidence to file a report with the authorities that the crime really happened. The act of examining the body is carried out by the method of opening all parts of the body starting from the pelvis, abdomen, chest, neck, and head and further examination is also carried out if necessary for the benefit of being able to obtain evidence for an investigation of a case in court, the use of forensic autopsy can make it easier for investigators to find the perpetrator and the cause of the crime. This study aims to determine forensic autopsy in proving criminal acts, doctors involved in the forensic autopsy process. This study was written with the formulation of the problem of the Position of Forensic Autopsy in Proving Criminal Acts with the research method used is normative research with secondary and primary data materials, and the approach method used in this study is the approach of legislation related to criminal acts and forensic autopsy. The results of this study indicate that the use of forensic autopsy can be one way to facilitate investigators in finding material truth, types of autopsies, the rights and obligations of victims and guardians in forensic autopsy, the role of the police in proving criminal acts, fines for doctors who falsify autopsy results and the position of forensic autopsy as evidence in proving criminal acts.
