Abstract

Kejahatan pencabulan terhadap anak di bawah umur merupakan pelanggaran serius yang menimbulkan dampak mendalam bagi korban, baik secara fisik maupun psikologis. Penelitian ini bertujuan untuk menganalisis pertanggungjawaban pidana terhadap wanita sebagai pelaku pencabulan anak di bawah umur serta mengkaji perlindungan hukum bagi anak yang menjadi korban. Rumusan masalah dalam penelitian ini adalah: (1) Bagaimana pertanggungjawaban pidana dari seorang wanita pelaku pencabulan anak dibawah umur? dan (2) Apa saja hambatan pemberatan dalam proses pemidanaan seorang wanita pelaku pencabulan anak dibawah umur? Hasil penelitian menunjukkan bahwa pertanggungjawaban pidana terhadap wanita pelaku pencabulan harus tetap didasarkan pada prinsip objektivitas, proporsionalitas, dan kontekstualitas. Gender pelaku tidak boleh menjadi faktor utama yang meringankan atau memberatkan hukuman, melainkan fokus pada tindakan dan dampaknya terhadap korban.
