Abstract

Undang-undang Nomor 1 Tahun 1974 tentang Perkawinan menyatakan bahwa perkawinan dikatakan sah apabila dilakukan sesuai dengan hukum agama masing-masing pihak, sehingga hal tersebut sering menjadi kendala bagi pasangan yang akan melakukan perkawinan beda agama. Dalam praktiknya, pasangan yang akan melakukan perkawinan beda agama dapat mengajukan permohonan ke Pengadilan Negeri untuk memperoleh penetapan. Akan tetapi, perbedaan dalam memahami suatu peraturan hukum oleh para hakim menciptakan ketidaksesuaian dalam putusan pengadilan terkait perkawinan beda agama. Beberapa hakim cenderung menolak permohonan dengan alasan bertentangan dengan asas legalitas dan norma agama, sementara hakim yang lain menerima dengan mengacu pada hak asasi manusia khususnya hak atas kebebasan beragama dan memilih pasangan hidup. Penelitian ini tujuannya agar mengetahui aturannya perkawinan berbeda agama serta mengetahui dasar pertimbangan hakim dalam mengabulkan serta menolak ketetapan No. 122/Pdt.P/2020/PN Pti dan ketetapan No. 423/Pdt.P/2023/PN Jkt.Utr. Metode penelitian yang dipergunakan yaitu menggunakan pendekatan perundangan, kasus serta konseptual. Hasil pembahasan yang diperoleh yaitu pengaturan perkawinan berbeda agama yang bervariasi mengakibatkan ketidakpastian untuk menerapkan UU No. 1/ 1974 serta menganalisis terhadap Penetapan No. 122/Pdt.P/2020/PN Pti dan Penetapan No. 423/Pdt.P/2023/PN Jkt.Utr yang menunjukkan perbedaan untuk menghadapi permohonan perkawinan berbeda agama. Dari perbandingan terhadap putusan-putusan tersebut diperlukan adanya pembaruan hukum yang dengan eksplisit mengatur perkawinan berbeda agama.
