Abstract
Penelitian ini bertujuan untuk mengetahui Pengaturan hukum mengenai Pemidanaan terhadap orang yang menyebarkan paham Radikal Terorisme di Indonesia serta mengetahui bentuk pencegahan yang dilakukan pemerintah dalam melindungi masyarakat dari paparan paham Radikalisme. Penelitian ini menggunakan metode penelitian hukum normatif dengan mengacu pada pendekatan perundang-undangan serta pendekatan konseptual. Hasil yang telah didapat menunjukan bahwa, Pengaturan Pemidanaan pelaku penyebaran paham radikal terorisme termuat dalam dalam Pasal 12B Ayat (3) serta Pasal 13A Undang-undang Nomor 5 Tahun 2018 Pemberantasan Tindak Pidana Terorisme berupa sanksi pidana dan denda. Disamping itu pelaku penyebaran paham radikal terorisme melalui Media Sosial juga dapat dijerat dengan menggunakan Pasal 45A ayat (2) Undang-undang Nomor 1 Tahun 2024 tentang Informasi dan Transaksi Elektronik (ITE) berupa pidana penjara dan juga denda. Namun, kedua aturan tersebut memiliki kelemahan, yaitu tidak secara eksplisit menyatakan radikalisme terorisme. Sehingga dapat berpotensi dalam penyalahgunaan wewenang oleh Penegak hukum dalam menentukan dan menindaklanjuti seseorang atau kelompok yang terlibat dalam penyebaran Paham Radikal Terorisme. Sementara itu, upaya pencegahan yang dilakukan Pemerintah terhadap penyebaran paham radikal terorisme diatur dalam Pasal 43C ayat (3) Undang-Undang Nomor 5 Tahun 2018 tentang Pemberantasan Tindak Pidana terorisme melalui Kesiapsiagaan Nasional, Kontra Radikalisasi dan Deradikalisasi. Upaya Pencegahan diharapkan mampu menghilangkan pengaruh Ideologi radikal Terorisme yang mengarah ke tindakan terorisme serta memberikan Perlindungan dan kepastian hukum bagi masyarakat.
