Abstract

Supreme Court Decision No. 28 K/Pdt/2016 is the final result of the plaintiff's legal struggle related to a lawsuit for unlawful acts in the unilateral termination of a cooperation agreement. The lawsuit was filed by the plaintiff against the defendants, which then went through a legal process until the Supreme Court examined, adjudicated, and partially granted the lawsuit filed by the cassation applicant, who previously had the status of Plaintiff/Appellant. The author is interested in examining this decision, especially regarding the legal considerations used by the Supreme Court in resolving the case. This research uses a normative juridical method with a statutory approach, document analysis, and a study of legal materials and related cases. Based on what is analyzed in the discussion and sourced from clear references, with a focus on the ratio decidendi in a tort lawsuit for unilateral termination of a cooperation agreement. The results showed that the Supreme Court's consideration in this case was in accordance with jurisprudence 04/Yur/2018 which stated that unilateral termination of the agreement was included in the unlawful act. Because, it violates the principles in Article 1338 of the Civil Code. In addition, the legal consequences of unauthorized termination of an agreement can include various losses for the injured party, both material and immaterial losses. Material losses can take the form of financial losses, such as delayed payments or cancellation of agreed obligations, while immaterial losses involve psychological impact, reputation, and disrupted business relationships. In addition, there is the elimination of rights and obligations that have not been fulfilled by both parties.
