Abstract

Pemalsuan tagihan BPJS yang dilakukan oleh pegawai rumah sakit telah menjadi perhatian serius dalam dunia hukum dan kesehatan di Indonesia. Tindakan ini tidak hanya merugikan negara secara finansial, tetapi juga mengurangi kepercayaan masyarakat terhadap sistem jaminan kesehatan. Penelitian ini bertujuan untuk menganalisis pengenaan sanksi terhadap pegawai rumah sakit yang terlibat dalam kasus tindak pidana pemalsuan tagihan BPJS di lingkungan rumah sakit, serta mengevaluasi tanggungjawab korporasi terhadap tindak pidana pemalsuan tagihan BPJS yang dilakukan oleh pegawai rumah sakit. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif dengan pendekatan perundang undangan, pendekatan konseptual, dan pendekatan kasus. Data diperoleh dari bahan hukum primer, sekunder, dan tersier, serta dianalisis menggunakan teknik analisis deskriptif kualitatif. Penelitian ini menemukan bahwa tindakan pemalsuan tagihan BPJS dapat dijerat dengan pasal-pasal dalam Kitab Undang-Undang Hukum Pidana (KUHP), Undang-Undang Nomor 24 Tahun 2011 tentang BPJS, dan peraturan terkait lainnya. Korporasi juga dapat dimintai pertanggungjawaban pidana melalui konsep strict liability dan vicarious liability, mengingat rumah sakit bertanggungjawab atas tindakan pegawai yang terjadi dalam ruang lingkup pekerjaannya. Hasil penelitian ini diharapkan dapat memberikan kontribusi terhadap pengembangan hukum pidana korporasi di Indonesia, khususnya dalam konteks rumah sakit, serta mendorong pengawasan yang lebih ketat terhadap pengelolaan BPJS di lingkungan rumah sakit. Selain itu, penelitian ini diharapkan dapat menjadi referensi dalam pembentukan regulasi yang lebih efektif untuk mencegah dan menindak kasus serupa di masa depan.
