Abstract

Penelitian ini meneliti tentang perlindungan hukum content creator streaming atau seseorang yang sedang melakukan live streaming di salahsatu platform bernama Youtube. Content creator tersebut menerima saweria atau donasi yang merupakan dukungan finansial dari penonton streaming khususnya fans dari creator tersebut. Dengan kemajuan teknologi seperti sekarang, di internet kita bisa menemukan hal positif maupun negatif. Dalam internet masyarakat dapat melihat beragam kejahatan khususnya judi online, karena situs judi online bisa sangat mudah melakukan promosi di platform mana saja khususnya di Youtube. Donasi yang berjumlah sangat besar dan tidak diketahui asal-usulnya darimana, menjadi isu penting di era digital saat ini. Dengan situasi seperti ini creator dapat terpidana tindak pidana pencucian uang, yang sesuai ditegaskan dalam Pasal 5 Undang Undang Pencegahan Dan Pemberantasan Tindak Pidana Pencucian Uang. Tujuan penelitian ini adalah untuk mengetahui dan menjelaskan pertanggungjawaban dan perlindungan creator yang tidak sengaja menerima donasi pencucian uang. Penelitian ini menggunakan pendekatan normatif dengan analisis terhadap peraturan perundang-undangan yang berlaku dan terkait kasus content creator streaming yang tidak sengaja menerima saweria dari money laundering. Hasil penelitian ini menjelaskan dalam Pasal 5 Undang-Undang Pencegahan Dan Pemberantasan Tindak Pidana Pencucian Uang, menegaskan bahwa Setiap Orang yang menerima atau menguasai penempatan, pentransferan, pembayaran, hibah, sumbangan, penitipan, penukaran, atau menggunakan harta kekayaan yang diketahuinya atau patut diduganya merupakan hasil tindak pidana. Perlu peran badan hukum PPATK untuk meverifikasi hasil donasi dengan jumlah yang sangat banyak, dan OJK untuk mengawasi dan mengatur transaksi keuangan yang melibatkan platform pembayaran atau layanan keuangan. Dan saran untuk pemerintah Indonesia untuk mengatur mekanisme Non- Conviction Based Asset Forfeiture (NCB) karena dapat membantu creator dalam mengatasi masalah yang berkaitan dengan menerima donasi dari pelaku kejahatan seperti situs judi, koruptor dan lain sebagainya.
