Abstract

The development of digital technology has created a new era in trading blockchain�based assets, including Non-Fungible Tokens (NFT), which has become a significant innovation in the world of digital art and virtual assets. NFTs offer uniqueness and technology-based authentication, making them a potential commercial tool for the protection of works of art. However, the use of NFTs also presents legal challenges, especially in terms of plagiarism and copyright infringement. This study aims to explore the legal regulations related to copyright of NFT-based works in Indonesia as well as the obstacles faced in providing legal protection to creators. Through normative legal research methods with conceptual and statutory approaches, this research refers to Law Number 28 of 2014 concerning Copyright and other related regulations. The research results show that, although NFTs function as digital proof of ownership and a licensing mechanism, the lack of specific regulations in Indonesia creates legal loopholes that can be exploited by irresponsible parties. The lack of clarity regarding the regulation of moral and economic rights in the context of NFTs further complicates law enforcement efforts. Additionally, the blockchain system used by NFTs, although guaranteeing transaction transparency, faces obstacles in the identification of wrongdoers due to its anonymous nature. NFTs not only require legal protection as a component of Intellectual Property Rights (IPR), but also require integration with the national legal system to provide legal certainty to creators. This research recommends regulatory updates that are adaptive to blockchain technology, more comprehensive implementation of smart contracts, and increasing public understanding of digital copyright protection.
