Abstract

In the government structure of the Republic of Indonesia, the President holds the highest power and is assisted by a Vice President in carrying out his duties. As part of the presidential institution, the Vice President functions to assist the President as regulated in Article 4 paragraph (2) of the 1945 Constitution. However, the constitutional regulation does not provide a detailed explanation of the duties and authorities of the Vice President, thus creating a gap in position between the two. This results in the Vice President often being considered to have only pseudo�authority that depends on the President's mandate. So from this study, the formulation of problem one is obtained, namely how to regulate the position of the Vice President in his duties to assist the President, and the formulation of problem two is what is the role of the Vice President if the President is incapacitated. This study uses a normative research method, using the legislative approach method and the conceptual approach. In this study, 2 types of legal materials were used, namely primary and secondary legal materials, the primary materials are in the form of laws and court decisions, while the secondary legal materials are in the form of books, scientific articles, journals and the internet. The results of the study show that constitutional changes, especially after the amendment to the 1945 Constitution, have strengthened the institutional relationship between the President and the Vice President. However, the position of the Vice President remains not entirely equal, both in terms of the division of tasks and in decision-making and the importance of more specific legal arrangements related to the duties and authorities of the Vice President so that the leadership function of the presidential institution can run more optimally.
