Abstract

The high number of cases of sexual violence against children makes people feel anxious and uncomfortable in family and social life. As a result, it becomes difficult to feel a sense of security and peace in the surrounding environment. Therefore, legal protection for children as victims and witnesses in cases of sexual abuse needs to be strengthened. Psychological and legal assistance must be improved to ensure children receive appropriate support during the legal process. In addition, every stage of justice must prioritize children's rights, such as access to information, medical and social rehabilitation, and the treatment provided. All of this must be in accordance with the provisions of Law Number 11 of 2012 concerning the Juvenile Criminal Justice System (SPPA). Apart from that, children as witnesses who are not sworn in are part of the information. Information in accordance with Article 185 paragraph (7) of the Criminal Procedure Code, this statement is to complement existing evidence (existing witness statements) so that children who are not sworn in are not the main witnesses, not the main evidence, but information that supports the evidence of witnesses who have been sworn in. This research uses normative juridical legal methods with a statutory approach, a conceptual approach and a case approach. The author concludes that there is harmony in implementing the protection of children's rights, both as victims and witnesses. These rights include medical and social rehabilitation, both inside and outside the institution, as well as easy access to case developments, as information regulated in Article 89 and Article 90 of the SPPA Law.
