Abstract

Salah satu pembaharuan penting dalam KUHP Nasional adalah penerapan hukuman mati bersyarat, yang memberikan peluang bagi terpidana mati untuk mengubah hukumannya menjadi penjara seumur hidup apabila selama masa percobaan menunjukkan sikap dan perbuatan terpuji. Penelitian menemukan bahwa frasa “sikap dan perbuatan terpuji” mengacu pada penyesalan yang tulus, kepatuhan terhadap aturan, dan kontribusi positif selama masa percobaan. Namun pasal ini belum memiliki pedoman atau indikator yang jelas sehingga menimbulkan tantangan dalam penerapannya, antara lain potensi subjektivitas dan inkonsistensi penilaian. Penelitian ini bertujuan untuk mengetahui bagaimana standar menentukan sikap dan perbuatan terpuji dalam Pasal 100 Ayat (4) Undang-Undang Nomor 1 Tahun 2023 tentang KUHP dan siapa pejabat yang berwenang dalam menentukan standar sikap dan perbuatan terpuji terpidana mati. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian ini adalah yang dimaksud dengan frasa “sikap dan perbuatan terpuji” adalah penyesalan yang tulus, ketaatan pada aturan, dan kontribusi positif selama masa percobaan. Namun pasal ini tidak memiliki pedoman atau indikator yang jelas sehingga menimbulkan tantangan dalam implementasinya, termasuk potensi subjektivitas dan inkonsistensi penilaian. Proses perubahan hukuman mati menjadi penjara seumur hidup melibatkan laporan lembaga pemasyarakatan, keterangan pihak ketiga, dan Keputusan Presiden berdasarkan pertimbangan Mahkamah Agung.
