Abstract

KPK has the authority to conduct wiretapping. With the results of wiretapping able to be used as evidence, the investigators who are careless in managing or storing evidence from wiretapping cause evidence to spread to the public or spread to other investigators who do not have authority. This thesis aims to know and understand the form of legal responsibility for the commission if the evidence of wiretapping results spread to the public and the position of the results of wiretapping by the commission spread to the public as evidence in court. The research method used is legal research with a legislative approach, a conceptual approach, and a comparative approach. The results of this study state the form of accountability for the KPK: if the evidence of wiretapping results spreads to the public, investigators must be reported to the KPK supervisory board. To be given punishment in the form of administrative sanctions or criminal sanctions if elements of intent or negligence of KPK investigators are found. The KPK is also obliged to recover the names of victims of wiretapping that spread to the public in the community. The position of the results of wiretapping by the KPK that are spread to the public can be recognized as valid evidence in court as long as the evidence is how to get it in a legitimate way according to the law and as long as the information contained in it can be accessed, displayed, guaranteed integrity, and can be accounted for so that it explains a situation.
