Abstract

Penanganan tindak pidana korupsi di lingkungan militer, khususnya dalam pengadaan barang dan jasa, menjadi isu penting yang memengaruhi integritas dan transparansi institusi pertahanan. Tujuan dilakukannya penulisan ini adalah untuk mengetahui Bagaimanakah Tindak Pidana Korupsi yang dilakukan oleh Pejabat Militer Bagaimanakah Penanganan Tindak Pidana Korupsi yang dilakukan di Lingkungan Militer, serta perlunya penyusunan prosedur khusus untuk penanganan kasus korupsi oleh anggota militer. Penelitian ini bertujuan untuk memahami kewenangan Komisi Pemberantasan Korupsi (KPK) dan Oditur Militer dalam menangani kasus korupsi di lingkungan militer serta mengkaji prosedur hukum yang berlaku di pengadilan militer. Metode penelitian yang digunakan adalah penelitian hukum normatif, dengan pendekatan perundang-undangan dan konseptual. Data diperoleh melalui analisis berbagai peraturan perundang-undangan, doktrin hukum, serta studi kasus yang relevan. Tindak Pidana Korupsi yang dilakukan oleh Pejabat TNI dimaknai sebagai pelanggaran terhadap Undang-Undang Nomor 25 tahun 2014 tentang Hukum Disiplin Militer dan pemenuhan unsur tindak pidana korupsi sebagaimana yang diatur dalam UndangUndang Nomor 31 Tahun 1999 sebagaimana telah diubah dan ditambah dengan Undang-Undang Nomor 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi. Tindak pidana korupsi yang dilakukan oleh Pejabat Tentara Nasional Indonesia yang termasuk ke dalam kriteria berdasarkan UU KPK Pasal 11, maka KPK berwenang melakukan penyidikan, hasil pemeriksaan yang dilakukan oleh dapat dijadikan sebagai dasar penyidikan oleh KPK dan untuk penanganan tindak pidana korupsi yang dilakukan bersama-sama oleh orang tunduk dalam lingkungan peradilan militer dan peradilan umum, KPK dapat bekerjasama melakukan penyidikan dengan Polisi Militer/Oditur Militer. Penelitian ini merekomendasikan peningkatan koordinasi antara Oditur Militer dan lembaga penegak hukum sipil, serta penguatan mekanisme pengawasan internal di TNI. Transparansi dan akuntabilitas dalam proses pengadaan juga perlu ditingkatkan melalui penerapan teknologi informasi dan audit independen.
