Abstract

This study examines the use of Land Value Tax (NJOP) and Land Value Zones (ZNT) in determining compensation for land acquisition for public purposes. NJOP and ZNT, as administrative and market indicators, should serve as the primary references for assessing the value of expropriated land. However, in the case of Decision Number 499/Pdt.G/2023/PN Tng, the Public Appraisal Service Office (KJPP) set the compensation value at IDR 8,720,000/m², significantly below the NJOP of IDR 14,095,000/m² and the ZNT range of IDR 10,000,000–IDR 20,000,000/m². The disregard of NJOP and ZNT sparked conflicts as these indicators more accurately reflect the market value of the land, which is strategically located in a business zone. This study reveals that neglecting NJOP and ZNT in the valuation process undermines the principles of justice and transparency, leading to resistance from landowners. As a recommendation, integrating NJOP, ZNT, and Fair Replacement Value (NPW) is essential to establish a more inclusive and accurate valuation system. This approach is expected to minimize conflicts, enhance public trust, and support equitable land acquisition for national infrastructure development.
