Abstract

Penelitian ini bertujuan untuk menganalisis pertanggungjawaban hukum perawat dan rumah sakit terkait kasus tertukarnya bayi dalam pelayanan kesehatan di rumah sakit, serta implikasinya terhadap penerapan prosedur dan regulasi medis. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Sumber bahan hukum utama yang digunakan meliputi Undang-Undang No. 17 Tahun 2023 tentang Kesehatan, KUHP, serta peraturan terkait lainnya, yang dianalisis untuk mengidentifikasi norma hukum yang mengatur pertanggungjawaban dalam kasus kelalaian medis. Penelitian ini menemukan bahwa perawat dan rumah sakit dapat dikenakan sanksi pidana atau administratif, tergantung pada tingkat kelalaian atau kesengajaan yang terjadi. Rumah sakit memiliki tanggung jawab yang lebih luas, termasuk kewajiban untuk memastikan prosedur identifikasi yang tepat dan pengawasan yang ketat dalam pelayanan medis. Implikasi dari penelitian ini menunjukkan perlunya perbaikan dalam sistem prosedur dan pengawasan, serta pelatihan yang lebih intensif bagi tenaga medis. Selain itu, rekomendasi dari penelitian ini mencakup pentingnya kepatuhan tenaga medis terhadap SOP, penegakan hukum yang tegas oleh aparat, serta peningkatan kesadaran masyarakat mengenai hak keselamatan pasien dan komunikasi yang jelas dengan tenaga medis.
