Abstract

The duty of disclosure is a fundamental element in insurance contracts, including life insurance. The duty of disclosure requires the insured to provide relevant and truthful information to the insurer regarding health conditions and other risk factors that may influence the insurer's decision to accept or reject an insurance application. Non-compliance with the duty of disclosure can pose risks for the insured, such as policy cancellation or claim denial by the insurer. The purpose of this study is to examine the legal rules that control the insured's obligation to disclose information in life insurance policies in Indonesia and to balance the implementation of the insured-insurer obligation to be transparent. This research examines Indonesian insurance laws, concepts, and regulations utilizing a statutory approach and normative legal methodology. particularly life insurance. The findings reveal that although legal provisions regulate the duty of disclosure in detail, there are still challenges in its implementation that may disadvantage the insured. These obstacles often arise because the importance of disclosure duties is not understood by the insured party, which is ultimately may harm the insured, and lack of supervision by insurance companies regarding the fulfillment of these obligations. Therefore, a regulatory balance and increased awareness of the duty of disclosure are required for both parties, the insured and the insurer, to minimize potential insurance disputes in the future. Efforts to enhance understanding will strengthen the principle of utmost good faith and support legal certainty for both the insured and the insurer.
