Abstract

ABSTRAK Penelitian ini membahas tentang proses pengambilan putusan oleh Mahkamah Konstitusi (MK) terkait batasan usia calon presiden dan wakil presiden di Indonesia, yang dilandasi oleh kode etik dan prinsip independensi peradilan. Dalam konteks pembatasan usia, isu tersebut menjadi perhatian besar, terutama setelah adanya Putusan Nomor 90/PUU-XXI/2023 yang mengubah persyaratan usia minimal untuk calon tersebut, memungkinkan calon di bawah 40 tahun dengan pengalaman sebagai kepala daerah untuk mencalonkan diri. Penelitian ini bertujuan untuk menganalisis posisi hakim dalam proses ketatanegaraan serta mekanisme Majelis Kehormatan Mahkamah Konstitusi (MKMK) dalam menangani dugaan pelanggaran kode etik. Dengan menggunakan metode penelitian hukum normatif, penelitian ini mengkaji peraturan perundang-undangan serta putusan-putusan MK sebagai sumber hukum primer. Hasil penelitian menunjukkan bahwa prinsip independensi dan integritas sangat penting dalam menjaga kredibilitas keputusan MK, terutama di tengah dinamika politik yang kerap memengaruhi proses pengambilan keputusan. Selain itu, MKMK memiliki peran sentral dalam mengawasi pelaksanaan kode etik oleh hakim, sebagai upaya menjaga kepercayaan publik terhadap lembaga peradilan. Penelitian ini diharapkan dapat memberikan kontribusi dalam memperkuat pemahaman mengenai pentingnya prinsip independensi dan imparsialitas dalam pengambilan putusan MK serta menyoroti peran pengawasan etika yang efektif dalam menjaga kepercayaan publik terhadap lembaga peradilan. Dalam konteks pemilu, penetapan batas usia calon presiden dan wakil presiden yang didasarkan pada pertimbangan etika dan independensi diharapkan dapat mencerminkan keadilan dan memperkuat demokrasi yang berkeadilan di Indonesia.
