Abstract

This research focuses on the exploitation of musical works on social media by digital platforms, using the case study of the Constitutional Court Decision Number 84/PUU-XXI/2023. With the development of digital technology, music has become one of the most frequently used types of content across various social media platforms, such as TikTok, Instagram, and YouTube, both as a video background and as the main content to attract users. However, this utilization is often not accompanied by proper licensing or compensation to copyright holders or related parties. This phenomenon has sparked legal debates regarding copyright protection in the digital era, particularly whether existing laws sufficiently protect the interests of creators from unauthorized exploitation. This study uses a normative juridical approach to analyze the legal aspects related to copyright on social media, as well as to review the Constitutional Court’s ruling. The research utilizes secondary data, including court decision documents, laws, scientific journals, and relevant literature, to provide a comprehensive overview of legal protection for musical works in the digital era. The analysis focuses on how copyright regulations are applied in the context of social media, and how creators' rights can be optimally protected. The findings of this study reveal weaknesses in the copyright protection mechanism on digital platforms, which make it difficult for creators to obtain justice for the exploitation of their works. The main challenges in implementing copyright on social media include the lack of supervision and the difficulty of enforcing cross-border laws, as digital platforms often operate globally. This study recommends the need for regulatory updates that strengthen copyright protection in the digital context, as well as the development of more adaptive supervision and law enforcement mechanisms in response to technological advancements. This abstract is expected to provide a comprehensive perspective on the issues of musical work exploitation on social media and offer practical solutions to strengthen copyright protection in the digital era.
