Abstract

Kepailitan pemilik properti sering menimbulkan ketidakpastian hukum bagi penyewa yang memiliki hak atas properti yang disewa. Dalam Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang, aset debitor yang pailit, termasuk properti yang disewakan, dikelola oleh kurator untuk pelunasan utang kepada kreditor. Hal ini menimbulkan permasalahan hukum mengenai perlindungan hak penyewa, terutama terkait keberlanjutan kontrak sewa yang telah sah. Penelitian ini bertujuan untuk menganalisis bentuk perlindungan hukum terhadap hak penyewa dan upaya hukum yang dapat ditempuh untuk mempertahankan hak-haknya ketika aset yang disewa dikelola oleh kurator dalam situasi kepailitan. Metode penelitian yang digunakan adalah metode hukum normatif dengan pendekatan perundang-undangan dan konseptual. Penelitian ini menelaah peraturan perundang-undangan terkait, termasuk Undang-Undang Kepailitan, Kitab Undang Undang Hukum Perdata, serta doktrin hukum dan putusan pengadilan. Analisis dilakukan berdasarkan prinsip pacta sunt servanda dan ketentuan Pasal 1576 KUHPerdata yang menjamin keberlanjutan kontrak sewa meskipun terjadi perubahan kepemilikan properti. Hasil penelitian menunjukkan bahwa perlindungan hukum terhadap hak penyewa dalam konteks kepailitan pemilik properti masih terbatas. Banyak penyewa kehilangan hak mereka karena kurangnya pemahaman terhadap prosedur hukum atau karena prioritas klaim kreditor yang mengesampingkan hak penyewa. Selain itu, peraturan yang ada belum memberikan pedoman spesifik terkait pengelolaan kontrak sewa dalam kepailitan. Karena itu, diperlukan langkah-langkah untuk meningkatkan kepastian hukum, seperti edukasi bagi penyewa dan perumusan regulasi yang lebih komprehensif. Penelitian ini memberikan kontribusi terhadap pengembangan kerangka hukum yang lebih adil bagi penyewa dalam situasi kepailitan pemilik properti.
